Terms of Service

These Terms govern your access to and use of the Newport Beach Hard Money Lenders website and related communications.

Effective date: April 20, 2026

1. Introduction and Agreement

These Terms of Service (“Terms”) are a binding agreement between you and Lead Skills, LLC (“Lead Skills,” “we,” “our,” “us”), the operator of Newport Beach Hard Money Lenders (the “Site”). By accessing the Site, submitting an inquiry, or otherwise using any feature of the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

2. Our Role: Lead Generation Service

Newport Beach Hard Money Lenders is a lead generation service. We connect borrowers with participating hard money lenders who may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All such activities are performed by the participating lender you may be matched with, in its sole discretion and subject to its own policies, procedures, and underwriting criteria.

Submitting information through the Site does not guarantee that you will be matched with a lender or that any lender will offer you financing.

3. No Offer or Solicitation

Content on the Site is provided for general informational purposes only. Nothing on the Site constitutes an offer, solicitation, commitment, recommendation, or guarantee to lend, to extend credit, or to enter into any financial transaction. Rates, terms, programs, and availability described anywhere on the Site are illustrative of loan programs that may be offered by participating lenders and are subject to change without notice. Not all applicants will qualify.

4. Eligibility

You must be at least 18 years old and legally capable of entering into a contract to use the Site. You agree to provide accurate, current, and complete information when submitting an inquiry, and to update that information as necessary. Providing false, misleading, or fraudulent information is prohibited.

5. Your Consent to Be Contacted

By submitting your phone number or email address and checking the consent box on our form, you provide your prior express written consent for one or more participating lenders, and for us and our service providers on their behalf, to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You can opt out at any time by replying STOP to any text message or by calling 949-822-9609. A current list of participating lenders is available upon request.

6. Equal Opportunity

Newport Beach Hard Money Lenders connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age (provided the applicant has the capacity to enter into a binding contract), or because all or part of the applicant’s income derives from any public assistance program, or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act.

7. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law.
  • Submit information about another person without that person’s authorization.
  • Interfere with or attempt to gain unauthorized access to the Site, its servers, or any related systems or networks.
  • Introduce viruses, malware, or other harmful code; scrape, crawl, or harvest data outside of normal browser use; or probe, scan, or test the vulnerability of the Site.
  • Reproduce, modify, republish, or redistribute Site content without our prior written consent, except as expressly permitted by these Terms.

8. Intellectual Property

The Site and its content, including text, graphics, logos, images, audio, video, compilations, and software, are owned by Lead Skills, LLC, its licensors, or its content providers, and are protected by copyright, trademark, and other intellectual property laws. Except for limited personal, non-commercial viewing, you are granted no license or right to use the Site content.

9. Third-Party Links and Services

The Site may contain links to, or may be integrated with, third-party websites, services, or tools that we do not own or control. We do not endorse and are not responsible for the content, privacy practices, availability, or security of third-party resources, and your use of them is subject to their own terms and policies.

10. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, LEAD SKILLS, LLC AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, AND UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT YOU WILL BE MATCHED WITH A LENDER OR RECEIVE ANY LOAN OFFER.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL LEAD SKILLS, LLC OR ITS AFFILIATES, OFFICERS, EMPLOYEES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Lead Skills, LLC and its affiliates, officers, employees, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your breach of these Terms, or your violation of any applicable law or the rights of any third party.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You and Lead Skills, LLC submit to the exclusive jurisdiction of the state and federal courts located in Orange County, California, for any action arising out of or related to these Terms or the Site.

14. Changes to These Terms

We may update these Terms from time to time. The “Effective date” at the top of these Terms indicates when they were last revised. Your continued use of the Site after updates are posted constitutes your acceptance of the revised Terms.
